Chromic Audio Terms of Use

1. Scope of Service
These Terms apply to the Chromic Audio app ("the App"): music playback, audio DSP (sound processing), sound personalization, device presets, and account/subscription features (when launched). Audio processing and personalization are performed on-device by default.
2. Relationship of Documents
These Terms apply together with the Privacy Policy and to the extent they do not conflict with Google Play store conditions. Material amendments will be notified in advance.
3. License
The company grants a non-exclusive, non-transferable, non-commercial personal license to use the App. Decompiling, reverse-engineering, redistribution, renting, and bypassing licensing or access controls are prohibited.
4. User Responsibilities
Users are responsible for securing their device and accounts and confirm they have the necessary rights to the music files they play. Where users configure personalization (DSP) settings themselves, they are responsible for the resulting listening environment.
5. Local Media and Intellectual Property
The App accesses and plays music files the user selects on their device and does not store or transmit them to servers. Intellectual property in the App itself (software, DSP algorithms, presets, trademarks, documentation) belongs to the company or the respective rights holders.
6. Audio / Hearing Safety Notice (Important)
- High playback volume or excessive DSP gain settings can strain your hearing. Excessive sound-pressure exposure may contribute to temporary threshold shift, tinnitus, discomfort, and temporary or permanent hearing damage.
- Maintain safe volume levels and listening durations; avoid excessively raising DSP gain to increase loudness.
- If you experience discomfort, pain, ringing, muffled hearing, or abnormal symptoms, stop listening immediately and consult a healthcare professional if symptoms persist.
7. Non-Medical Nature
Chromic Audio is not a medical device and does not diagnose, treat, cure, mitigate, or prevent any disease or hearing damage. WiseAudio/ActiveTune measurement and personalization features provide reference data for personal listening-environment optimization; they do not replace professional hearing tests, medical diagnosis, treatment, hearing aids, or audiological consultation.
8. Device/Headphone Variation and User-Selected DSP Risk
Identical settings may produce different actual output depending on the device, earphones/headphones, content, and listening environment. User-selected DSP settings can increase signal level or perceived loudness; do not ignore the App's warnings or risk indicators.
9. Subscription / Paid Features (when launched)
Paid subscription (klisten_pro_subscription) is provided through Google Play Billing; payment, cancellation, and refunds follow Google Play policy and applicable law. Intended base prices: USD 6.88/month or USD 68.88/year — store-localized prices and taxes may change the actual amount. New users: 1 month free; existing (legacy) users: 6 months free (legacy eligibility verification to be finalized during implementation). Subscriptions renew automatically for the stated period unless cancelled in Google Play subscription settings. Detailed terms and product configuration to be updated after Play Console setup.
10. Service Changes and Interruption
The company may update the App or change/discontinue features for improvement, policy compliance, or technical stability.
11. Disclaimer and Limitation of Liability
- The App is provided "AS IS". To the maximum extent permitted by applicable law, the company is not liable for special, indirect, or consequential damages, failure to meet expected sound quality due to device/headphone/environment differences, consequences of user-modified settings, or third-party service interruptions.
- To the maximum extent permitted by law, the company is not liable for consequences of the user operating volume or DSP settings at unsafe levels. This does not limit liability that cannot be waived by law (e.g., gross negligence, intentional misconduct, mandatory product liability).
- However, user rights and company liability that cannot be waived by law (consumer protection, product liability, gross negligence, intentional misconduct, etc.) are not limited.
- To the maximum extent permitted by law, the company's total aggregate liability is limited to the greater of amounts paid in the last 12 months or USD 100 (or equivalent). [To be finalized after legal review]
12. Termination
Users may stop using the App and delete their account at any time (Privacy Policy, Section 8). The company may restrict service or suspend an account for material breach of these Terms, violation of law, or service abuse.
13. Governing Law / Dispute Resolution
These Terms are governed by the laws of the Republic of Korea; the exclusive forum for disputes is the Seoul Central District Court.
